Please read these Terms Of Use carefully before using this site. By using this site, you are agreeing to these Terms Of Use. If you do not agree with any of the below Terms Of Use, do not use this site. CEC Entertainment Concepts, L.P. (CEC Entertainment) reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms Of Use at any time and you agree to be bound by such modifications, alterations or updates.
Regardless of changes in these Terms Of Use, personally identifiable information will never be used in ways materially different than stated in these Terms of Use without first providing you a meaningful opportunity to opt-out or prevent that use.
A SPECIAL NOTE FOR PARENTS CONCERNING PRIVACY
CEC Entertainment makes a special effort to encourage children to consult with their parents before furnishing data. However, CEC Entertainment believes that parents should supervise their children's online activities and consider using parental control tools available from online services and software manufacturers that help provide a kid-friendly online environment. These tools can also prevent children from disclosing online their name, address, and other personal information without parental permission.
We do not seek to acquire information specifically from children under the age of 13 on the Chuck E. Cheese's website.
PRIVACY
CEC Entertainment is very respectful of the privacy concerns of the visitors to its sites on the Internet. As a general policy, no personal information is automatically collected from visitors to its sites. However, certain non-personal information of visitors is recorded by the standard operation of CEC Entertainment Internet servers. This information is primarily used to provide an enhanced online experience for the visitor. Information tracked includes the type of browser being used by the visitor (e.g., Netscape, Internet Explorer), the type of operating system (e.g., Macintosh, Windows) in use by the visitor and the domain name of the visitor's Internet service provider (e.g., America Online, Earthlink). By having this information, web pages optimized for a particular visitor's computer is automatically available to that visitor. Other uses of this information include internal review of the number of visitors to the sites but only in an aggregate and non-personally-identifiable form. Email addresses and other personally identifiable data about visitors to this site are known to CEC Entertainment only when voluntarily submitted.
HOW WE USE PERSONAL INFORMATION PROVIDED BY VISITORS
Through our site we may receive names, email addresses, email content, ages, billing information, parental contact information, shipping information, or other information that visitors voluntarily provide. This information may be retained by CEC Entertainment but is not sold outside the company.
With certain functions and features like Guest relations/feedback section, information is utilized for the purpose of completing the function, and then all contact information is deleted from our electronic databases.
We may from time to time use email addresses and other personally identifiable information to contact visitors who communicate with us, such as receiving our email newsletters or being notified if they have won one of our contests. Every email sent in this manner will contain instructions on how to unsubscribe from future mailings and change the information that is contained in that individual's profile.
At any time, you may later review or update the your personally identifiable information by writing us at guestrelations@cecentertainment.com. To safeguard your information, we will also take steps to verify your identity before granting access or correction. Although we do not seek to collect information from children, parents may, after providing proper parental identification, request to review, update, or delete their own child's information that may have been submitted.
Appropriate physical, electronic, and managerial procedures have been put in place to protect the integrity and security of all information we obtain.
This information is used to better understand how visitors use our sites and to support transactions made on the sites. An overview of this data (i.e., number of users, usage patterns, etc.) may be provided to other parties for marketing, advertising or other uses.
Many websites, including this one, place a "cookie" in the browser files of your computer. The cookie itself does not contain any personally identifying information. Although the cookie could enable someone to relate a user's use of a CEC Entertainment site to information that the user has specifically and knowingly provided, CEC Entertainment does not do this. PHOTOGRAPH, VIDEO AND TEXT SUBMISSION POLICY
PLEASE READ THIS POLICY AND THESE TERMS OF USE CAREFULLY BEFORE SUBMITTING TO CEC. Note that certain terms apply to any and all Submissions (as hereinafter defined) that may not apply to other CEC websites or apps (“CEC Sites”). Subject to applicable law, any such terms are in addition to terms of use applicable to other CEC Sites, and in the event of a conflict, these terms of use prevail with respect to Submissions over those terms of use applicable to other CEC Sites. By clicking a box that states that you accept or agree to these terms, you signify your agreement to the Terms of Use, CEC’s Privacy Policy and this Policy. If you do not agree to these terms of use, you may not make a Submission.
In this Policy and these Terms of Use, we use the word "Submissions" to mean text, messages, artwork, photographs, drawings, videos, sound recordings, your and/or other persons' names, likenesses, voices or other information or material that you submit, post, upload, embed, display, communicate or otherwise distribute (collectively, "Distribute") to CEC.
You may not make a Submission for commercial purposes or in any way that is unlawful, or harms us or any other person or entity.
By Distributing your Submission to CEC Entertainment, Inc. (hereinafter referred to “CEC” which also includes its subsidiaries, affiliates, agents and licensees) you confirm that you are the owner of the Submission or have the permission of the original owner to submit the Submission, that you have the permission of everyone who appears in it, and that anyone featured who is under 18 years old is either a member of your immediate family or has given you permission to submit the Submission.
Furthermore, by Distributing your Submission you grant CEC the following rights: a royalty-free, worldwide, perpetual license to display, distribute, reproduce, and create derivatives of the Submission, in whole or in part, without further review or participation from you, in any medium now existing or subsequently developed, in editorial, commercial, promotional, and trade uses in connection with CEC Products and Services. CEC may license or sublicense, in whole or in part, to third parties rights in the Submission as appropriate to distribute, market, or promote such CEC Products and Services.
CEC will review each Submission and in its sole discretion determine the appropriateness of each Submission prior to displaying it on CEC Sites or elsewhere.
CEC’s Right to Remove and Refusal to Display. Without prejudice to any of our other rights under these terms of use or at law, we reserve the right to (a) refuse to post or communicate or remove any Submission that violates these terms of use (including the Rules of Conduct) and (b) to the extent we are able to do so under applicable law, identify any user to third parties, and/or disclose to third parties any Submission or personally identifiable information, when we believe in good faith that such identification or disclosure will either (i) facilitate compliance with laws, including, for example, compliance with a court order or subpoena, or (ii) help to enforce these terms of use and /or protect the safety or security of any person or property. Moreover, we retain all rights to remove Submissions at any time for any reason or no reason whatsoever.
Indemnity. You hereby agree to indemnify, defend, and hold CEC and its officers, directors, owners, employees, agents, representatives and assigns (collectively, the "Indemnified Parties") harmless from and against any and all losses, damages, liabilities and costs (including settlement costs and any legal or other fees and expenses for investigating or defending any actions or threatened actions) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these terms of use or claims arising from your Submission. You shall use your best efforts to cooperate with us in the defense of any claim. We reserve the right, at our own expense, to employ separate counsel and assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
Data Retention. We will retain your Submission for as long as is needed to: provide you services; comply with our legal obligations; resolve disputes; and enforce our agreements. If you wish that we no longer use your Submission to provide you services please contact us at memories@cecentertainment.com.
Subject to laws to the contrary, we may amend these terms at any time and without notice to you. We may immediately terminate these terms of use with respect to you in our absolute discretion including, without limitation, if you breach or fail to comply with any material term or provision of these terms of use.
CALIFORNIA PRIVACY RIGHTS
California Civil Code Section 1798.83 allows our California customers to request certain information regarding our disclosures in the prior calendar year, if any, of personally identifiable information to third parties for their own direct marketing purposes. To make such a request, please contact us at either guestrelations@cecentertainment.com or CEC Entertainment, 4441 W. Airport Freeway, Irving, TX 75062, Attn: Marketing Department, and include your name and the address to which you would like us to respond. We will attempt to provide you with the requested information within thirty (30) days of receipt.

WARRANTIES DISCLAIMER

To the fullest extent permissible pursuant to applicable law, CEC Entertainment disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. EMAILS AND POSTINGS RECEIVED
Do not post any threatening or libelous emails or material on this site that would be considered a violation of any law. CEC Entertainment will fully cooperate with any law enforcement authorities or court order requesting or directing CEC Entertainment to disclose the identity of anyone posting any such emails or materials.
JURISDICTIONAL ISSUES
Unless otherwise specified, the materials in Chuck E. Cheese's website are presented solely for the purpose of entertainment and promotion. This site is controlled and operated by CEC Entertainment from its offices within the State of Texas, United States of America. CEC Entertainment makes no representation that materials in Chuck E. Cheese's website are appropriate or available for use in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. This agreement shall be governed by, construed and enforced in accordance with the laws of the State of Texas, as it is applied to agreements entered into and to be performed entirely within such State. Any action you, any third party or CEC Entertainment bring to enforce this agreement or, in connection with, any matters related to this site shall be brought only in either the state or Federal Courts located in Dallas, Texas and you expressly consent to the jurisdiction of said courts. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing, signed by CEC Entertainment.
Except for disputes regarding the collection and use of personally identifiable information, which may be processed through the BBBOnLine Privacy Dispute Resolution Service, this agreement shall otherwise be governed by, construed and enforced in accordance with the laws of the State of Texas, as it is applied to agreements entered into and to be performed entirely within such State. Any action you, any third party or CEC Entertainment bring to enforce this agreement or, in connection with, any matters related to this site shall be brought only in either the state or Federal Courts located in Dallas, Texas and you expressly consent to the jurisdiction of said courts. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
